BULLETIN – CONTRACT INFORMATION CLARIFICATION 10/25/2021
Members FOP3:
This morning incorrect information was given to the members of the SD Baker Shift by a city official. This erroneous information was in regards to who came up with the idea of permanent shifts in patrol and who formally proposed it in the negotiating process for this current proposed contract. I would like to thank Police Commissioner Harrison for clearing this matter up.
See Below from PC Harrison:
Dear President Mancuso:
I understand that a question has arisen in the ratification process regarding the origin of the change from rotating to permanent shifts in the Patrol Schedule. The Department is the party that presented this change to the FOP Lodge No. 3 as part of a series of modifications we sought in connection with the overall restructuring of the Department schedules.
Sincerely,
Michael Harrison
Police Commissioner
PENSION LAWSUIT DECISION HANDED DOWN – 8/16/2021
August 16, 2021
Sisters and Brothers,
Today we received word that the Court of Appeals has handed down their decision relative to our pension lawsuit against the City of Baltimore.
In its decision, the Court has completely affirmed the ruling of Judge Rubin in the Circuit Court and, as such, has granted relief to the retiree portion of the case but not to the active portion that sought to return the years of retirement to 20. The retirees who are eligible will receive the monies associated with the list of recipients in regard to damages and retirement will remain at 25 years.
As to the active members’ portion of this suit, the question of the day has been whether or not the city can now raise the retirement years of service to 30 years. The short answer, it appears, is that they can. A precedent has now been set. The next question then is why should I stay with the Baltimore Police Department not knowing if the 25-year retirement will be increased to a 30-year retirement at the whim of an already untrustworthy city government. I believe remaining with the BPD is an individual decision but keep in mind that the city has no boundaries as to how far they will go to harm the lives of those who put their own lives on the line to protect its citizens. With that in mind, I urge you to do what is best for you and your families even if that means joining another department that will treat you with the respect you deserve.
This suit started in 2010 and members of FOP3 should know that for over a decade you didn’t just let the city push you around. We tried to hold the city accountable for what we felt was a breach of contract, but by no means was this the decision we were looking for in terms of the active members and some of the retirees.
Please see the attached bullet points provided by our attorneys at Saul Ewing and the full copy of today’s Court of Appeals decision.
Fraternally,
Mike Mancuso
New Lawsuit Filed Against City 8/6/2021
August 6, 2021
All,
Like all of you, I received Commissioner Harrison’s new promotional policy last week and noticed issues with the new policy. In response, I contacted SBWD and several of us met with Herb Weiner, Mike Davey, and Kieren Dowdy to discuss our options. In response, I have directed our attorneys to file an unfair labor practice lawsuit, which was served on the Labor Commissioner of Baltimore City today.
Thanks,
