NOTICE TO BALTIMORE CITY PENSION LITIGATION CLASS MEMBERS RECEIVING CASH AWARDS On September 15, 2021, the Maryland Court of Appeals issued its mandate in Robert F. Cherry, Jr., et. al v. Mayor and City Council of Baltimore City, No. 36 (2021) affirming the final judgment issued by the Baltimore City Circuit Court (“Court”) effective March 30, 2020. The City of Baltimore is now obligated to pay the damages awarded to the class with post-judgment interest through September 15, 2021, totaling $35,280,990.29. Distributions to class members receiving cash awards will be made after the Court rules on any applications seeking awards to be deducted from the judgment of attorneys’ fees, costs and expenses, and class representative incentive payments (“Applications”). On September 27, 2021, the Court entered an Order setting a schedule for consideration of such Applications, providing for notice to those class members receiving a cash award, and giving instructions for filing objections. Class members are directed to view the Class Action Website, www.BaltimorePensionLitigation.com, to view the September 27, 2021, Order, the Applications, any filed objections, and additional information regarding this case. Applications must be filed by October 1, 2021. If class members receiving cash awards object to any Application, they must file their objection by November 15, 2021. Responses to any objection must be filed by November 24, 2021. After briefing on the Applications is complete, the Court may hold a fairness hearing. Notice of the fairness hearing, if scheduled, will be sent by electronic mail to objectors and posted to the Class Action Website. Final distributions to class members receiving cash awards will not be mailed until after the Court rules on the Applications.
